Permitted Uses and Setbacks for Different Zoning Districts

Residential District 

Permitted uses.  Uses permitted in the R-1 district are as follows:

  1. Single-family dwellings;
  2. Public schools, parks, playgrounds and recreational areas;
  3. Churches and church schools;
  4. Hospitals;
  5. Public utilities; mains; transmission and distribution lines, substations and exchanges only;
  6. Home occupations;
  7. Fences, hedges and walls; provided such uses are less than three and a one-half feet in height when constructed of materials tending to obstruct motorists’ vision and when located within seventy-five feet of the centerline intersection of two streets or roads;
  8. Accessory buildings and uses normally appurtenant to single-family residences.  (Ord. 184 §3(A), 1972; Ord. 327 §1(A), 1989)

Development standards.  In the R-1 district, the development standards are as follows:

  1. Minimum lot area per dwelling,seven thousand square feet 
  2. Minimum lot width per dwelling, seventy-five feet 
  3. Minimum Front Yard.
    1. Principal buildings, twenty-five feet,
    2. Accessory buildings, twenty-five feet,
  4. Minimum Rear Yard.
    1. Principal buildings, twenty feet, (Ord. 406, 2002)
    2. Accessory buildings, five feet,
  5. Minimum side Yard.
    1. No residential dwelling shall be located nearer than five feet to any side lot line but shall be at least one foot for every three feet of building height as measured from finished exterior grade at the sidewall of the dwelling. (Ord. 406, 2002)
  6. Accessory buildings, five feet on each side,
  7. Side yard abutting a street, twenty-five feet.
  8. Minimum floor area, (not including basement, carport or garage), per dwelling, seven hundred fifty feet;
  9. Floor area ratio, not to exceed 0.4;
  10. Minimum off-street parking per dwelling, two spaces;
  11. Minimum open space per dwelling, thirty percent of total lot area;
  12. Maximum building height, not to exceed twenty-five feet or two and one-half stories and no less than one story above ground.  (Ord. 184 §3(L), 1972)  

Prohibited uses.   In the R-1 district, the following uses are prohibited:  livestock and poultry.  (Ord. 184 §3(L), 1972)

Permitted uses.  Uses permitted in the R-2 district are as follows:

A.        Any uses permitted in the R-1 district.  Single-family dwellings must conform to the requirements of the Ault Municipal Code

  1. Two-family dwelling. 
  2. Multi-Family dwelling.  (Ord. 184 §4(A), 1972)  

Development standards.  In the R-2 district, the development standards are as follows:

  1. Minimum Lot Area per Dwelling Unit in Square Feet.
    1. Two-family dwelling, five thousand;
    2. Multi-family dwelling:
      1. Four-bedroom or over, five thousand,
      2. Three-bedroom, three thousand five hundred,
      3. Two-bedroom, two thousand six hundred,
      4. One-bedroom, or efficiency, two thousand;
  2. Minimum Lot Width.
    1. Two-family dwelling, seventy-five feet;
    2. Multiple-family dwelling, one hundred feet.
  3. Minimum front yard, all dwellings, twenty-five feet;
  4. Minimum Side Yard.
    1. Two-family dwelling, ten feet on each side,
    2. Multiple-family dwelling, two side yards having a combined width of fifteen feet and neither side yard less than five feet.
  5. All side yards abutting a street, twenty-five feet;
  6. Minimum Rear Yard.
    1. Two-family dwelling, thirty feet,
    2. Multiple-family dwelling, twenty-five feet;
  7. Minimum Ground Floor Area per Dwelling Unit (Not Including Basement, Garage or Carport).
  8. Two-family dwelling, six hundred square feet,
  9. Multiple-family dwelling, five hundred square feet;
  10. Floor Area Ratio.
    1. Two-family dwelling, not to exceed 0.5,
    2. Multiple-family dwelling, not to exceed 0.5;
  11. Minimum Off-street Parking.
    1. Two-family dwelling, two spaces per dwelling unit,
    2. Multiple-family dwelling, two spaces per dwelling unit;
  12. Minimum Open Space.
    1. Two-family dwelling, not less than three thousand square feet per dwelling unit,
  13. Multiple-family dwelling, not less than nine hundred square feet per dwelling unit.  (Ord. 184 §4(B—K), 1972  

Prohibited uses.  In the R-2 district, the following uses are prohibited: livestock and poultry.  

Permitted uses.  Uses permitted in the MH district are as follows:

            A.        Mobile home park when approved as a planned unit development; 
            B.        Planned unit development on a site not less than five acres in area;
            C.        Uses indicated by the planned unit development when approved.  (Ord. 184 §5(A), 1972
 
General requirements. 

A.        Reference should be made to Title 16 of this code for the requirements and procedure for submission of a planned unit development plan.

B.        Reference should be made to Chapter 15.08 of this code for additional requirements.  (Ord. 184  §5(B), 1972)  

 Prohibited uses.  In the MH district, the following uses are prohibited: livestock and poultry. (Ord. 184 §5(C), 1972)  

Commercial District

Permitted uses.  Uses permitted in the C district are as follows:

            A.        Any general business and commercial retail activity, including:
                        1.         Automobile repair shops;
                        2.         Bakeries, 
                        3.         Banks, 
                        4.         Laundries, 
                        5.         Personal service shops, 
                        6.         Restaurants, 
                        7.         Printing and publishing establishments;

            B.        Boarding and rooming houses;

            C.        Hotels and motels, including incidental business;

            D.        Medical and dental clinics;

            E.         Membership clubs, subject to approval of the planning commission;

            F.         Nurseries and greenhouses;

            G.        Private schools and uses as permitted;

            H.        Professional offices;

            I.          Governmental offices, police and fire stations.  (Ord. 184 §6(A), 1972; (Ord. 327 §1(B), 1989)

General requirements. 

            A.        Goods sold shall consist primarily of new merchandise and any goods produced on the premises shall be sold at retail on the premises unless other wise permitted in this title for special uses.

            B.        Processes and equipment employed and good processed or sold shall be limited to those which are not objectionable by reason of odor, dust, smoke, cinders, gas, noise, vibration, refuse matter or water-carried waste as determined by planning commission:

                        1.         Places serving food or beverages outside of an enclosed building; 
                        2.         Places of amusement or recreation; 
                        3.         Advertising sign boards; 
                        4.         Gasoline station.

            C.        Residence for proprietor and family of a permitted commercial use shall be allowed, subject to approval by the planning commission and town board.  (Ord. 184 §6(B), 1972) 

Development standards.   The development standards in the C district are as follows:

            A.        Minimum lot area per motel, hotel, rooming-house or resort lodge, six thousand square feet (refer to Section 17.44.010 of this title);

            B.        Minimum lot width per motel, hotel, rooming-house or resort lodge, fifty feet (refer to Section 17.44.040 of this title);

            C.        Minimum front yard, where all the frontage on side of the street between two intersecting streets is zoned as a commercial district, no setback shall be required.  Where the frontage of one side of a street between two intersecting streets is zoned partly as residence and partly as business, the setback requirements of the R-2 multiple-family residence district shall apply to the entire frontage.

            D.        Minimum Side Yard.

                        1.         No side yard shall be required of a building constructed of masonry or fireproof materials provided the wall or walls are located on a property line.  In all other cases, a side setback of three feet shall be required.  In the event rear access to the property is not available, then a twelve-foot setback shall be required on one side.

                        2.         For motels, hotels and rooming-houses, the side yard requirement for multiple-family dwellings in the R-2 residential district shall apply.

            E.         Minimum Rear Yard.  All building and structures shall have a rear yard of not less than fifteen feet, which may include one-half the width of an alley.

            F.         Minimum Floor Area.

                        1.         Per unit for motels and hotels, three hundred square feet; 
                        2.         Per occupant for rooming and boarding houses, two hundred square feet;
                        3.         All other permitted uses, three hundred square feet.

            G.        Maximum building height, not to exceed forty feet or three stories in height;

            H.        Minimum Off-street Parking.

                        1.         For motels, hotels, one space per unit;
                        2.         For commercial retail sales and service establishments, three square feet of parking space for every one square foot of sales and service floor area; 
                        3.         For restaurants and other establishments handling the sale and consumption on the premises of food and/or beverages, one space for each fifty square feet of gross floor area.  (Ord. 184 §6(C—J), 1972)  

INDUSTRIAL DISTRICT  


Permitted uses.  

            A.        In the I district, a lot, parcel or tract of land may be used, and/or buildings or structures may be erected, altered or remodeled and used for a use that is determined by the planning commission and the town board.

            B.        Residential uses will be limited to living quarters for custodian, guard or maintenance personnel only, in connection with an industrial use being carried on upon the same premises.  (Ord. 184 §7(A) (1, 3), 1972)  

 Application procedures.   Application for industrial district uses shall be accompanied by the following:

            A.        Certified boundary survey of property for which application is made;

            B.        Plot plan showing location of all proposed buildings, parking areas, ingress and egress, storage areas, waste disposal areas, other construction features, and landscaping;

            C.        Description of proposed operation in sufficient detail to indicate effects of operation in producing air and water pollution, odor, noise, glare, fire or other safety hazards, and traffic congestion;

            D.        Plans for disposal of sewage or other wastes;

            E.         Plans for water supply;

            F.         Plan showing drainage and drainage facilities;

            G.        Architectural elevations for any proposed buildings;

            H.        Proposed number of shifts to be worked and maximum number of employees;

            I.          Identification signs, size, type, location and number.  (Ord. 184 §7(A) (2), 1972)            

Development standards.   In the I district, the development standards are as follows:

            A.        Minimum Front Yard.

                        1.         All buildings and structures, fifty feet; 
                        2.         The first fifteen feet of the front yard shall be used exclusively for landscaping and ingress and egress.

            B.        Minimum Side Yard.

                        1.         No side yard shall be required of a building constructed of masonry or fireproof materials, provided the wall or walls are located on a property line; 
                        2.         A side yard of fifteen feet on each side shall be required if a building is to be constructed of non-fire-proof materials; 
                        3.         In the event rear access to the property is not available, a side yard of twelve feet shall be required on each side.  (Ord. 184 §7(C—G), 1972) 

 AGRICULTURAL DISTRICT  

 Permitted uses.   Uses permitted in the A district are as follows:

            A.        Farm dwelling or building appurtenant to agricultural use;
            B.        Crop production; 
            C.        Grazing;
            D.        Greenhouse;
            E.         Nursery;
            F.         Sod (turf) farm;
            G.        Storage of farm products and private farm equipment.
            H.        Truck farming;
            I.          Single-family dwelling on minimum lot size of five acres;
            J.         Parks and open space;
            K.        Kennels, subject to approval by the planning commission.  (Ord. 184 §8(A), 1972; Ord. 327 §1(C), 1989)

Development standards.  The development standards in the A district are as follows:

            A.        Minimum lot area, five acres;
            B.        Minimum lot width, one hundred seventy-five feet;
            C.        Minimum front yard, fifty feet;
            D.        Minimum side yard, twenty feet.  On corner lots, the side yard shall be fifty feet for the principal building;
            E.         Minimum Rear Yard.
                        1.         Principal buildings, twenty feet,
                        2.         Accessory buildings, ten feet;
            F.         Minimum floor area per dwelling, one thousand square feet.  (Ord. 184 §8(B—G), 1972)
